Government loses FiT appeal attempt
The Government has lost its attempt to appeal over its plans the reduce the Feed-in Tariff with effect from 12 December 2011. Responding to the decision, Ed Davey, Secretary of State for Energy & Climate Change, said, ‘We are disappointed by the decision of the Supreme Court not to grant permission to hear this case. But the court’s decision draws a line under the case. We will now focus all our efforts on ensuring the future stability and cost effectiveness of solar and other micro-generation technologies for the many, not the few’
The Supreme Court rejects the case because it ‘does not raise an arguable point of law of general public importance which ought to be considered’.
One consequence of the ruling is that solar PV installations registered between 12 December 2011 and 3 March 2012 will qualify for an FiT of 43.3 p/kWh rather than 21 p/kWh.
