Why fire dampers (really) matter
A close examination of the crucial role played by fire and smoke control dampers in protecting people and property captures the much wider shift in culture needed to address the whole issue of building safety failings, according to BESA’s Technical Director, Kevin Morrissey.
The most revealing failures always the most obvious. Sometimes they sit in a ceiling void, behind an access panel (or where one that was never installed should have been), or inside a length of ductwork passing unobtrusively through a compartment wall.
Fire and smoke control dampers are small components in a much larger safety strategy, but they tell us a great deal about the state of competence, accountability and culture across the built environment.
They also expose a persistent industry dilemma: When a damper is incorrectly selected, badly installed, inaccessible, untested or poorly documented, the problem is rarely confined to one trade or one moment in the project. It may begin in design, be compounded during installation, missed at commissioning and finally discovered years later by a maintenance contractor with no contractual responsibility for the original work. By then, commercial interests, legal duties, insurance concerns and moral obligations can all be pulling in different directions.
That is why fire dampers matter far beyond their modest physical presence. In a fire, they are expected to help maintain compartmentation by closing off ductwork routes through which flame, heat and smoke could otherwise travel.
Immediate threat
Smoke is often the greatest immediate threat to life and a major cause of property damage, so the integrity of the damper, its frame, its penetration seal and its interface with wider controls all become critical. A certificate on file is not enough if the damper does not operate as intended at the crucial moment.
The heightened scrutiny that followed the Grenfell Tower disaster has rightly pushed the construction and building management sectors to examine the detail of life safety systems. Dampers are one of those details.
The Building Engineering Services Association (BESA) updated the industry’s guidance DW145: ‘Guide to Good Practice for the Installation, Design and Selection, Inspection and Maintenance of Fire Dampers’ after reports from annual maintenance inspections revealed significant numbers of incorrectly installed dampers, including many that did not follow manufacturers’ instructions, some that were damaged, dampers that had never been tested and many that could not be accessed at all.
This matters because the legal position is unambiguous. Duty holders must be able to demonstrate that fire safety systems are maintained in efficient working order under the Regulatory Reform (Fire Safety) Order 2005 in England and Wales, with equivalent duties applying in Scotland and Northern Ireland.
BS9999 also places clear emphasis on routine inspection and testing, with fire dampers generally tested at least annually depending on system type and risk. In practical terms, this means accurate asset registers, evidence of access, functional test records, photographs, defect reports and clear remediation trails.
BESA backed this up with a new training programme, BESA DW145 Fire Damper Inspection and Maintenance, delivered through its online Academy and by partner training providers. It has been designed to help operatives demonstrate the fire damper skills and knowledge needed to inspect, test, record and escalate any defects quickly.
The comprehensive training programme reflects the fact that damper inspection is not simply a box-ticking exercise, or even a simple mechanical ‘drop’ test. It requires an understanding of physical condition, blade and frame damage, actuator performance, penetration seals, access provision, functional operation, resetting and the relationship between dampers, fire alarms and building control systems.
This is a microcosm of the competence culture needed to underpin building safety and keep occupants safe. A competent person does not merely record that an asset exists. They understand what they are looking at, why it matters, what evidence is required and when a defect is serious enough to demand urgent attention. They also know the limits of their own role, which is especially important when defects are found in work carried out by others.
The unresolved question is what happens when competent people find evidence that a life safety system is defective, but the commercial pathway for fixing it is unclear. BESA members frequently report difficulties accessing dampers for statutory maintenance, and even greater difficulty getting serious defects acted upon once they have been reported.
This is one of the grey areas in building services where responsibilities can become scrambled between designers, installers, principal contractors, building owners, managing agents, responsible persons and facilities teams.
Significant defects
A familiar scenario illustrates the problem. A specialist ventilation firm is asked to survey and price works on a residential building, including fire and smoke control systems, but does not win the original contract. Two years later, while tendering for maintenance, the same firm identifies significant defects in the installed dampers.
It raises the issue with the building owner or manager, only to be told by the principal contractor that the system was commissioned, certified, and ‘signed-off (by building control)’.
Further investigation reveals inconsistencies in the records, including defects recorded as corrected that are still visible on-site.
This is where the industry’s culture is tested. A contractor may have no contractual ‘skin in the game’, but if it has credible evidence that a life safety system cannot be operated or maintained properly, does its responsibility end with a report? If the client does not act, should the concern be escalated to the Responsible Person, the Accountable Person, building control, the fire and rescue authority or, in relevant circumstances, the Building Safety Regulator? At what point does professional concern become a duty to just keep trying?
These are uncomfortable questions because they sit at the junction of ethics and commerce. Contractors do not want to be seen as difficult. Clients do not welcome expensive surprises. Principal contractors may rely on commissioning records. Insurers may scrutinise every word. Yet none of those pressures changes the basic purpose of the system: to help protect people and property in a fire. If defects are known, recorded and left unresolved, the paperwork can become part of the problem rather than proof of control.
The Building Safety Act has changed the conversation because it makes accountability more explicit and strengthens the idea that safety information must be reliable, accessible and maintained. Although the new regime is most developed for higher-risk buildings (HRBs), its cultural influence is wider. It asks everyone in the chain to think less about defending their immediate contractual position and more about whether the building can be shown to be safe in use.
That distinction is important. Identifying a defect is not the same as accepting liability for causing it. A maintenance contractor can and should be able to record an unsafe or non-compliant condition without being dragged into a dispute over who created it. Equally, a building owner or manager should have a defensible process for receiving such information, assessing its seriousness, applying interim control measures where necessary, commissioning remediation and preserving the evidence trail.
This is the practical gap BESA is seeking to close by bringing together technical, regulatory and management expertise to develop an industry case study and guidance note. The aim is not to create another layer of theory, but to clarify what reasonable steps look like when serious damper defects are discovered.
That includes escalation routes, thresholds for urgent concern, interim controls, documentation standards and the point at which specialist advice or regulatory involvement may be needed.

Professionally curious
Interim Chief Construction Advisor Thouria Istephan has argued that the industry needs a much stronger focus on professional skills and personal accountability. “If we are not professionally curious, we will not become technically competent. If you work in the construction industry and do not feel the weight of the responsibility you have for keeping people safe, you are in the wrong job,” she says.
Professional curiosity is not a slogan. It is the habit of asking whether a damper can actually be reached, whether the seal is appropriate, whether the actuator works, whether the installation matches the manufacturer’s instructions, whether the test record corresponds with what is physically present, and whether the system as a whole can perform as designed. It is also the courage to ask what happens next if the answer is ‘no’.
Qualifications, licensing and certification are essential foundations, but they are not the complete answer. The industry also needs clients who understand their duties, procurement teams that value competence, designers who make maintenance possible, installers who follow tested details, commissioning processes that verify reality rather than paperwork, and facilities teams with the authority to act on defects.
Stakeholders and duty holders at all levels and disciplines need to recognise that they remain accountable for service or work they do regardless of the building control and gateway planning process.
In that sense, the damper dilemma is a microcosm of the wider building safety challenge. It shows how easily safety can be weakened when responsibility is fragmented, information is poor and access for maintenance is treated as an afterthought. It also shows how the new safety culture can take root: through competence that is demonstrable, records that are verifiable, escalation routes that are understood and decisions that are made with the occupants of the building in mind.
Fire dampers will always be hidden, but the accountability around them is becoming ever more visible. Fire safety professions and their clients have access to the specialist guidance and the training along with the regulatory momentum to improve. What they now need is the collective ‘curiosity’ to treat every inaccessible damper, every inconsistent record and every unresolved defect as a warning sign that the people occupying the building may not be safe.
